Terms & Conditions

Welcome to Kalinga Ride ("we," "our," or "us"). These Terms & Conditions constitute a legally binding agreement between the customer ("Hirer," "User," or "You") and Kalinga Ride, governing your reservation, rental, and operation of our self-drive vehicles across Bhubaneswar, Biju Patnaik International Airport (BBI), Patia, Chandrasekharpur, and destination routes across Odisha and India.

1 Driver Eligibility & Mandatory Documentation

To ensure road safety and comply with the Indian Motor Vehicles Act, all Hirers must fulfill the following verification criteria prior to vehicle dispatch:

• Age Requirement: The primary Hirer must be at least 21 years of age at the time of booking.
• Driving License: You must present an original, valid, non-expired Indian Driving License for Light Motor Vehicles (LMV). Learners' licenses, photos of licenses on mobile phones without Digilocker/mParivahan verification, or commercial badges without LMV entitlement are strictly non-acceptable.
• International Drivers: Foreign nationals or Non-Resident Indians (NRIs) must produce a valid International Driving Permit (IDP) alongside their original national driving license and a valid passport with visa stamp.
• Identity & Address Proof: An original Aadhaar Card, Passport, or Voter ID must be presented for identity matching. Physical originals will be verified by our delivery executive during key handover.
• Authorized Drivers: Only the person(s) registered and verified in the official rental agreement are legally permitted to operate the vehicle. Allowing an unregistered individual to drive immediately voids all insurance coverages and incurs a penalty.

2 Booking, Tariffs & Security Deposit

Our pricing policy is 100% transparent with zero surprise charges:

• Rental Tariff: Includes vehicle rental charges, applicable goods and service taxes, and standard commercial vehicle insurance. Fuel, highway tolls, parking tickets, and interstate border entry permits are not included in standard daily tariffs.
• Refundable Security Deposit: A refundable security deposit (ranging between ₹3,000 and ₹5,000 depending on vehicle segment) is required prior to trip commencement. This deposit acts as security against potential traffic e-challans, minor fuel discrepancies, or late returns.
• Deposit Refund Timeline: Following the safe return of the vehicle and a standard traffic challan database verification, the security deposit is initiated for refund within 24 to 48 hours to the customer's original payment method or bank UPI.

3 Vehicle Inspection, Delivery & Handover

To protect both parties, a structured joint inspection is conducted during pickup and return:

• Pre-Handover Inspection: Our executive and the Hirer will jointly perform a complete walkaround inspection, documenting the fuel gauge, odometer reading, tyre condition, toolkit, spare tyre, and pre-existing minor scratches via digital photos or video recordings.
• Vehicle Acceptance: Once you accept the keys and inspect the car, you confirm that the vehicle is mechanically sound, clean, and roadworthy.
• Return Condition: The vehicle must be returned in reasonably clean condition. Extreme interior soiling, mud stains, pet hair, or food spills requiring professional upholstery shampooing will attract a standard interior cleaning charge of ₹500 to ₹1,000.

4 Fuel Policy & Highway FASTag

We maintain a straightforward, fair fuel and toll management procedure:

• Same-to-Same Fuel Policy: The vehicle is delivered with a recorded fuel level (e.g., 25%, 50%, or full tank). The Hirer is expected to return the vehicle with an equivalent fuel level. If returned with less fuel, the differential fuel cost plus a nominal refueling charge will be deducted from the security deposit. No cash refund is issued for excess fuel returned.
• FASTag Electronic Tolls: Every Kalinga Ride vehicle is equipped with a functioning FASTag affixed to the windshield. All toll plaza charges incurred on national and state highways during your rental are recorded digitally and settled from the security deposit or billed upon final checkout.

5 Permitted Usage & Geographical Limits

Hirers must operate the vehicle strictly in accordance with legal and safe motoring guidelines:

• Geographical Territory: Vehicles are authorized for travel across Odisha (including Puri, Konark, Chilika, Gopalpur, Sambalpur) and designated outstation circuits approved in advance. For interstate travel (e.g., West Bengal, Andhra Pradesh, Jharkhand), the Hirer must inform us prior to departure to ensure proper state road permit compliance.
• Prohibited Uses: The vehicle shall not be used for:
  • Commercial passenger transport, taxi aggregator services, or sub-leasing to third parties.
  • Motor racing, speed testing, drifting, off-roading, or driving across unpaved riverbeds and beaches.
  • Transportation of hazardous chemicals, illegal contraband, wildlife products, or weapons prohibited under Indian law.
  • Towing or pushing other vehicles, trailers, or heavy machinery.
• Non-Smoking & Alcohol Prohibition: In accordance with Odisha state regulations and passenger comfort, smoking, vaping, and consumption of alcohol inside the vehicle are strictly prohibited. Violations incur a sanitization fee of ₹1,500.

6 Speed Governance & Traffic Challans

Safe driving is non-negotiable for the well-being of our customers and pedestrians:

• Speed Governor: In compliance with Government of India and transport authority mandates, all commercial rental vehicles are fitted with electronic speed governors calibrated at a maximum speed of 80 km/h.
• Traffic Violations & E-Challans: The Hirer is 100% legally and financially liable for all traffic violations, speed camera tickets, signal jumps, wrong-side driving, illegal parking citations, and automated e-challans issued by Odisha Traffic Police or National Highway authorities during the active rental period.

7 24/7 Roadside Assistance & Breakdown Support

Kalinga Ride provides comprehensive 24×7 customer and roadside assistance across Odisha:

• Emergency Contact: In the event of a mechanical failure, engine alert, flat tyre, or unforeseen stoppage, call our 24/7 helpline immediately at +91 7752046356.
• Unauthorized Repairs: Hirers must not attempt major repairs, electrical tampering, or third-party mechanical work without express authorization from Kalinga Ride management.
• Tyre & Puncture Policy: Standard roadside punctures during the trip are the operational responsibility of the driver. In the rare event of tyre bursts caused by manufacturing defects, our technical team will facilitate assistance.

8 Accidents, Damages & Insurance Policy

All Kalinga Ride vehicles are covered by comprehensive commercial motor vehicle insurance:

• Mandatory Accident Reporting: In case of an accident or collision, the Hirer must immediately notify Kalinga Ride, photograph the scene and vehicle damage, and register a Police Diary (GD/FIR) if third-party injury or severe property damage is involved.
• Hirer Liability Cap: In genuine accidental damage covered by comprehensive insurance, the Hirer's liability is capped at the standard insurance depreciation excess amount (typically ₹5,000 to ₹10,000 depending on the vehicle category), provided the driver was not operating in violation of the terms below.
• Loss of Insurance Immunity: Insurance coverage is completely invalidated, and the Hirer becomes 100% liable for all damages, third-party claims, and vehicle total-loss costs if:
  • The driver was under the influence of alcohol, drugs, or intoxicating substances.
  • The vehicle was operated by an unregistered or unverified individual.
  • Damage resulted from intentional recklessness, severe waterlogging submersion, off-road driving, or gross negligence.

9 Cancellation, Rescheduling & Refunds

We believe in honest, customer-friendly flexibility when your travel plans change:

• Cancellations 24+ Hours Before Pickup: 100% refund of the advance booking deposit.
• Cancellations Within 12–24 Hours: A nominal cancellation fee equal to 50% of the first day's rental tariff is retained; the balance is refunded promptly.
• Cancellations Under 12 Hours or No-Show: The first 24-hour rental tariff is non-refundable due to vehicle reservation holding.
• Trip Rescheduling: Free trip rescheduling is permitted up to 12 hours prior to scheduled pickup, subject to fleet availability for the revised dates.

10 Late Return & Trip Extensions

We understand that traffic conditions or road trip discoveries can alter travel timing:

• Grace Period: We offer a complimentary 30-minute grace window for scheduled vehicle returns.
• Extension Requests: If you wish to extend your journey, notify us at least 3 hours prior to your scheduled return time via phone or WhatsApp. Extensions are granted subject to vehicle reservation schedules.
• Unauthorized Late Returns: Unannounced delays exceeding the grace period are charged at standard hourly late fees (₹200 to ₹350 per hour) to compensate incoming reservations.

11 Governing Law & Jurisdiction

These Terms and Conditions shall be governed, interpreted, and construed in accordance with the laws of the Republic of India. Any legal dispute, arbitration, claim, or difference arising out of or relating to this agreement shall be subject to the exclusive jurisdiction of the competent courts in Bhubaneswar, Odisha.
